Terms of Service
TumaChat for WhatsApp (wa.tumatext.co.ke) — last updated 20 October 2026
These terms govern the use of TumaChat for WhatsApp, a business messaging platform of Tumatext Limited (“Tumatext”, “we”, “us”) built on the WhatsApp Business Platform of Meta Platforms, Inc. (“Meta”). By using it you agree to them. If you use it on behalf of a business or other organisation (a “client”), you agree for that organisation.
1. The service
TumaChat for WhatsApp sends and receives WhatsApp messages on a client's own WhatsApp Business number: event invitations and other template messages requested through our API or our other products (such as TumaInvite), replies to people who write to the client's number, and the answers they give. It also manages the client's message templates and keeps a log of the conversations on the number for the client's admin. The features available to an account are set by Tumatext and may differ between accounts.
2. Accounts and access
- An account belongs to the client. Tumatext sets it up and connects the client's WhatsApp number; the client's admin signs in to see the account's message log.
- Keep your password, two-step verification codes and any API key to yourself. An API key acts for the whole account: tell us straight away if you think one, or your password, has been used by someone else, and we will revoke it.
- The client must give us, and keep current, the access its WhatsApp Business Account needs, and may withdraw it at any time in Meta Business Settings.
3. WhatsApp and Meta
- Every use of the service must also follow Meta's terms: the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and the WhatsApp Business Terms of Service. The client accepts those terms with Meta for its own WhatsApp Business Account.
- Message templates are reviewed by Meta. Meta, not Tumatext, decides whether a template is approved, and may pause or reject it.
- Meta may limit, restrict or disable a number or account, for example because of its quality rating or a policy breach. Tumatext cannot override such decisions; messages may not be delivered while they apply.
- Meta charges for some messages. Those charges are the client's, as agreed with Tumatext or under the client's own arrangement with Meta.
4. The client's responsibilities
The client, not Tumatext, is responsible for whom it messages and what it says. In particular the client must:
- message only people who have given it their number and agreed to hear from it on WhatsApp (opt-in), as Meta's policies require, and have a lawful basis to collect and use their personal data;
- tell those people how their details will be used, where the law requires it;
- stop messaging anyone who asks it to, or who blocks or reports its number;
- make sure the content of its templates, invitations and event details is accurate, lawful and its own to use.
5. Acceptable use
You must not use TumaChat for WhatsApp to send spam, unsolicited bulk or marketing messages, or unlawful, misleading or harmful content; to message people who have not opted in; to harass anyone; to impersonate another person or organisation; to offer anything Meta's policies prohibit; or to try to access another account's data, disrupt the service or get around its security or limits. We may suspend an account, an API key or a number that breaks these terms, Meta's policies or the law, or that puts the service, Meta's platform or others at risk.
6. Data
The client keeps ownership of its messages, contacts and templates, and gives Tumatext permission to store, process and transmit them only as needed to provide the service. For the personal data of the people it messages, the client is the controller and Tumatext processes it on the client's behalf. Messages are kept for 12 months and then deleted. How we handle personal data is described in our Privacy Policy, and how to have it deleted on our data deletion page.
7. Availability
We work to keep TumaChat for WhatsApp available and reliable, especially on event days, but we cannot promise it will always be uninterrupted or error-free. The service depends on Meta's WhatsApp Business Platform, which is outside our control. We may change, improve or withdraw features. Clients should keep their own records of anything critical to them.
8. Liability
TumaChat for WhatsApp is provided “as is”. Tumatext is not responsible for the content of a client's messages, for its event, for how a client obtained its contacts' numbers, or for any act, decision or outage of Meta or WhatsApp, including a message not delivered or a template, number or account restricted by Meta. To the extent the law allows, Tumatext is not liable for any indirect or consequential loss, or for any loss, claim or issue arising from the actions of a client, its users or the people it messages. Nothing in these terms limits liability that cannot be limited by law.
9. Suspension and ending
A client may stop using TumaChat for WhatsApp at any time and ask us to delete its account and data. We may suspend or close an account that breaks these terms, whose access to WhatsApp is withdrawn by Meta or the client, or that is no longer in use, with notice where reasonable. A suspended account sends and receives no messages through us, and its users cannot sign in; its data is kept until the account is reinstated or deleted, or the 12 months above run out.
10. Changes and law
We may update these terms; the date at the top shows when they last changed, and continuing to use Tumatext WhatsApp after a change means accepting it. These terms are governed by the laws of Kenya.
